GENERAL CONDITIONS REGARDING RESERVATION AND ACCOMODATION AT THE MEMLING HOTEL

  1. GENERAL

    These general conditions form an integral part of the contract concluded between Memling Hotel (hereinafter referred to as "Hotel") and the Guest, whether or not concluded through the Hotel's website.

  2. AVAILABILITY

    All rooms offered by the Hotel are subject to availability and the discretion of the Hotel manager. Priority will be given to rooms that were paid for at the moment of reservation.

  3. RESERVATION

    For reservations made through our website (www.memling.net), the Guest must provide, amongst other things, a valid e-mail address on the reservation form. The Hotel takes no responsibility for the consequences of any incorrect information submitted by the Guest.

    Once the electronic payment has been verified, the Hotel automatically sends a confirmation e-mail to the Guest, which must be retained for check-in purposes. Reservations are not final until the confirmation e-mail has been sent.

  4. DAY USE

    Accommodation during the day ("day use") is subject to the availability of rooms on that day, and is only possible between 9h00 and 16h00. Reservations for day use will be taken into account at the earliest moment possible on the day prior to the day of arrival. In case of departure after 16h00, a supplementary overnight accommodation shall be charged.

  5. CHECK IN / CHECK OUT

    Guests must present a valid personal ID or passport when checking in.

    Rooms are made available to Guests as from 14h00. Guests who wish to have access to their room before 14h00 must inform the Hotel in advance and obtain a written confirmation from the Hotel. In such case, the room shall be booked as from the day before, and a supplementary overnight accommodation shall be charged.

    Guests must check out before 11h00 on the day of departure. All late departures between 11h00 and 16h00 must be notified to the reception and shall be charged in accordance with the posted up rates. One night's accommodation shall be charged in case of departure after 16h00.

  6. RENUNCIATION AND CANCELLATION

    Guests have the right to cancel their reservation until 24 hours before arrival, by written notice to the Hotel.

    (meaning, at the latest at 14h00 on the day prior to arrival).

    After this time, one night of accommodation shall be charged automatically, and the remainder of the reservation shall be cancelled in the reservation system. The same rules apply to reservations for which a Guest fails to show.

  7. PRICE

    Prices are shown per room and per night, for the number of persons and dates indicated. All prices include taxes (VAT included). The displayed prices do not include supplements (for example, for single occupancy or additional room facilities), expenses incurred at the hotel, including, without limitation, use of minibar, safety deposit box, external phone calls, room service, meals (other than those stated at the time of reservation), personal travel insurance, items of personal expenditure, bar, restaurant, laundry, etc.

    The Hotel does not grant credit for the services it provides and the goods it sells. All expenses incurred during the stay, including the bar, restaurant, laundry, phone and others, must be paid in cash immediately before checking out the hotel.

    Guests must pay their entire reservation within three (3) days of the reservation.

    The Guest may address the Hotel in writing (by mail or by e-mail) to request different payment conditions. The Hotel reserves the right to accept or reject such conditions. Without prejudice to any terms and conditions expressly agreed upon by the Guest and the Hotel in writing, the Hotel reserves the right to cancel all reservations which have not been paid within the allowed term.

    The Hotel accepts payments in cash, by transfer or by credit card. Payments by cheque are not accepted.

    The Guest may contact the booking agency of the Hotel to obtain information regarding advances and advanced payments: tel +243 (0)81 700 11 11 – fax +243 (0)81 301 33 33 – info@memling.net. The booking agent will inform the Guest on the steps to be taken and will provide the bank details of the Hotel.

  8. RESERVATIONS BY COMPANIES OR ORGANISATIONS BENEFITING FROM A SPECIAL AGREEMENT

    All reservation requests, whether by phone, mail or e-mail, made by companies or organisations that have concluded a special agreement with the Hotel, must be confirmed by an order form, if the Hotel has granted credit facilities to this company or organisation.

    If no agreement was concluded with respect to credit facilities, the payments conditions of clause 8 shall apply. After expiry of the three (3) day term provided under clause 8, the reservation will be cancelled and the Hotel will re-enter the booked rooms into the reservation system.

    Credit facilities will be granted provided that all overdue amounts are paid within thirty (30) days of receipt of the invoice. In case of failure to comply with this provision, the Hotel may demand payment in advance of the total amount for all future reservations.

    The Hotel reserves the right to cancel any reservation in case of failure to comply with this clause 9.

  9. RESPONSIBILITIES OF THE HOTEL

    The Hotel shall be liable for damage resulting from its wilful intent or gross negligence, or that of its representatives and agents, or resulting from its failure to comply with its material obligations under this agreement. The Hotel shall also be liable in case of death or physical injury of the Guest, as a result of acts or negligence of the Hotel.

    In its capacity of bailee, the Hotel shall be responsible for all objects brought to the Hotel by the Guest, but only within the strict limits of articles 1952-1954 quater of the Belgian Civil Code. The Hotel shall not be liable for any deterioration, destruction or theft of the those objects that can be imputed to the Guests or people accompanying, visiting or serving him, that result from armed robbery or that result from the nature or defects of the object.

    The Hotel's responsibility for all other cases than those exhaustively indicated above, shall be limited to the price paid by the Guest for his reservation.

    The Hotel does not accept any liability for destruction or theft of vehicles parked on the Hotel's premises, for services rendered by third parties to Guests, even if those services were organised by the Hotel, for damage, losses, expenses and any other sums which did not result from any breach of contract or other fault by the Hotel or, where the Hotel is responsible for them, of its employees, agents or suppliers.

    In any event, the Guest must immediately notify the Hotel of any discovered damage, in order for his claim to be admissible.

  10. GUEST RESPONSIBILITIES

    The Guest shall be liable for damage caused by his act, omission or negligence. If the damage is discovered after the Guest has left, the Hotel reserves the right to charge the Guest's credit card with; or to send an invoice for, the amount required to repair any such damage.

  11. FORCE MAJEURE

    The Hotel is not liable and shall not owe any compensation or damages if it is unable to fulfil its contractual obligations due to force majeure, or if the Guest suffers damage as a result of a force majeure event. For the purposes of this clause, "force majeure" shall mean all facts and circumstances which the Hotel could not reasonably foresee or prevent, such as, for example, natural or nuclear disaster, war or the threat of war, terrorist activities or the threat thereof, strikes, floods, fires, etc.

  12. PERSONAL DATA

    For all information regarding the treatment of personal data, the Guest is referred to the Hotel's Privacy Policy, which constitutes an integral part of these general conditions.

  13. APPLICABLE LAW AND JURISDICTION

    These general conditions are governed by Belgian law. The Hotel and Guest submit to the exclusive jurisdiction of the courts of Brussels, Belgium to settle any dispute which may arise out of or in connection with these general conditions. If the amount of the dispute does not exceed € 1.860, the justice of peace of the second district of Brussels will be exclusively competent to handle the dispute.
